GFit Nutrition Privacy Notice

GFit Nutrition, LLC ("GFit Nutrition," "we," or "us") respects your privacy and is committed to protecting your privacy when you use or visit the GFit Nutrition website at www.gfitnutrition.com, including its related sites, pages, content, the GFit Nutrition app, program, system, challenge, meals, recipes, and meal plans (collectively, the "Site"). This privacy notice (our "Privacy Notice" or "Notice") describes:
- The types of information we may collect from you or that you may provide us; and
- Our practices for collecting, using, maintaining, protecting, and disclosing that information.
This Notice applies only to information we collect through the Site and in email or other electronic communications sent through or in connection with the Site. This Privacy Notice DOES NOT apply to information that:
- We collect offline or through any other means, including from any other website or social media or other platform operated by GFit Nutrition, its affiliates, or any third party; or
- You provide to or is collected by any third party, including through any application or content that may link to or be accessible from or on the Site. These third parties may have their own privacy policies, which we encourage you to read before providing information on or through them.
Changes to this Privacy Notice
This Notice may change from time to time, and you are responsible for checking this Privacy Notice periodically for updates when accessing or using the Site. The date the Privacy Notice was last revised is identified at the top of the page. If we make material changes to how we treat your personal information, we will notify you through a notice on the Site home page or notify you by email. Your continued use of the Site after we make changes to this Privacy Notice is deemed to be your acceptance of those changes.
Creating an Account; Account Security
To access the Site, the GFit Nutrition app, or some of the resources we offer, such as any of our programs, systems, challenges, meals, recipes, and meal plans, you may be asked to provide certain information. It is a condition of your use of the Site that all the information you provide on the Site is correct, current, and complete. Sign-in to the GFit Nutrition app is by secure email link (no password required); you are responsible for keeping your email account secure and for all activity occurring under your account.
We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel subscriptions in our sole discretion.
As part of the account creation process, in addition to the information enumerated in the section below regarding "Information We Collect and How We Collect It," we may also ask for certain details about your health, fitness level, and health goals, such as sex, age, height, weight, waist measurement, and activity level. We use this information to personalize the services we provide to you and do not share it with any third party, except as described herein.
Information We Collect and How We Collect It
At any given time, we may collect several types of information from and about users of our Site, including information:
- By which you may be personally identified, such as your name, IP and/or physical address, email address, phone number, or any other identifier that can be used on its own or with other information to identify, contact or locate you ("personal information");
- That is about you, but individually does not identify you; and
- About your internet connection, the equipment you use to access our Site and other usage details.
We may collect this information:
- Directly from you when you provide it to us;
- Automatically when you access or use the Site; and/or
- From third parties, such as vendors or business partners.
Information You Provide to Us
The information we collect on or through our Site may include:
- Information that you provide by filling in forms on our Site or contacting us via email or text, including, but not limited to, information you provide at the time you create an account, sign up for or subscribe to communications from GFit Nutrition, post any materials, submit or support user reviews, and/or at the time you contact us;
- Records and copies of your correspondence with us;
- Your responses to forms, surveys, or questions that we might pose or ask you to complete;
- Details of any transactions you may carry out through third-party or other payments systems available on or through our Site, including order fulfillment and customer service information; and
- Self-measured body metrics you enter into Site tools, such as your height and waist measurement when using the waist-to-height ratio calculator.
Automatic Information Collection and Tracking
When you access and use the Site, we may use technology to automatically collect information, which may include:
- Location data;
- Length of time you visit our Site;
- Page views, click-stream information, and referring URL and logs;
- The resources and devices that you access and use on or through the Site; and/or
- Information about your device and internet connection, such as the device's unique device identifier, IP address, operating system, browser type, and network information.
Tracking Technologies and Third-Party Tools We Use
We and our third-party service providers use cookies, web beacons, pixel tags, and other similar tracking technologies (collectively, "tracking technologies") to gather information when you interact with our Site and email communications. Some tracking technologies are necessary for the Site to function; others help us analyze usage and run advertising. Below is a description of the specific tools currently in use:
Essential Cookies
Essential cookies are necessary to the core functionality of our Site, such as maintaining your session and providing access to secure areas. We don't provide an opt-out for these; you can remove them via your browser settings, but some Site features may then be unavailable.
Meta (Facebook) Pixel and Conversions API
We use the Meta Pixel (a code-based tracking tool) and the Meta Conversions API (a server-side event tool) to measure the performance of our advertising on Meta platforms (Facebook, Instagram), build advertising audiences, and optimize ad delivery. These tools collect information about your interactions with our Site — including pages viewed, the waist-to-height calculator, checkout initiation, and purchases — and send that information (including hashed email addresses, IP addresses, and browser/device data) to Meta. We use a shared event identifier to deduplicate browser and server events. For more information on how Meta collects and uses this data, see Meta's Privacy Policy. You may manage your Meta advertising preferences through your Meta Ad Preferences.
Google Analytics 4
We use Google Analytics 4 ("GA4"), a web analytics service provided by Google LLC, to understand how visitors find and use our Site. GA4 uses cookies to collect information such as your operating system, browser, IP address, referring URL, and date and time of your visit, and sends this data to Google servers, which may be located within or outside of the United States. We use GA4 to track key engagement events, including purchases and calculator completions. By accepting this Notice, you consent to the processing of your data by Google. For more information, visit Google's Privacy Policy. To opt out of Google Analytics tracking, you may use the Google Analytics opt-out browser add-on.
Microsoft Clarity
We use Microsoft Clarity, a behavioral analytics tool provided by Microsoft Corporation, to understand how visitors interact with our Site through heatmaps and session recordings. Session recordings may capture scrolling, clicks, and mouse movement. Clarity is configured to mask sensitive input fields (such as payment fields) so that no sensitive information is captured. The data collected by Clarity may be processed by Microsoft on servers within or outside the United States. Google reCAPTCHA v3
We use Google reCAPTCHA v3 on our sign-in form to protect against automated abuse. reCAPTCHA collects hardware and software information, including device and application data, and sends this data to Google for analysis. This service is subject to Google's Privacy Policy and Terms of Service.
Authorize.net (Payment Processing)
Payment transactions on our Site are processed by Authorize.net, a third-party payment processor. We do not store your full credit card number; that information is handled by Authorize.net under its own security standards and privacy policies. By purchasing, you agree to Authorize.net's terms and policies.
Web Beacons and Other Technologies
Pages of our Site and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us to count users who have visited those pages or opened an email and for other related Site statistics.
You can set your browser to refuse all or some cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Site may then be inaccessible or not function properly.
How We Use Your Information
We generally use information that we collect about you or that you provide to us to improve our Site and to deliver a better and more personalized service, including to:
- Present our Site and its contents to you and provide the 28-Day Metabolic Reset program and related services;
- Process your membership purchase and automatic annual renewals via Authorize.net;
- Send you secure sign-in links, receipts, program updates, and service communications;
- Personalize your experience, including meal selections and shopping lists;
- Schedule and administer your 1-on-1 kickoff call;
- Estimate audience size and usage patterns;
- Maintain information about your preferences and customize the Site;
- Recognize you when you return to our Site;
- Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for delivery, billing, and collection;
- Measure and optimize the performance of our advertising campaigns; and
- Allow you to participate in interactive features of our Site, such as the waist-to-height ratio calculator.
We may also permit third parties to use tracking technologies on our Site for analytics and advertising, including to help manage and display advertisements or to tailor advertisements to your interests. Disclosure of Your Information
We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction. In addition, we may disclose personal information that we collect or you provide:
- To our affiliates, contractors, service providers, and other third parties we use to support our business operations, including our payment processor (Authorize.net), hosting providers (Amazon Web Services), email and communication tools, scheduling tools, and analytics and advertising platforms (Google, Meta, Microsoft);
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of GFit Nutrition's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by GFit Nutrition about our users is among the assets transferred;
- To fulfill the purpose for which you provide it;
- For any other purpose disclosed by us when you provide the information or with your consent;
- To comply with any court order, law, or legal process, including to respond to any government or regulatory request;
- To enforce or apply this Privacy Notice, our Terms of Use; or
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our company, our affiliates, users, or others.
Except as provided herein, personal information collected through the Site will not be sold or otherwise disclosed to third parties for direct marketing purposes.
Your Choices About Collection, Use, and Disclosure
- Tracking Technologies. You can set your browser to refuse all or some cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Site may then be inaccessible or not function properly.
- Google Analytics. You may opt out of Google Analytics tracking by using the Google Analytics opt-out browser add-on.
- Meta Advertising. You may manage your Meta ad preferences at facebook.com/ads/preferences or through the Digital Advertising Alliance opt-out at optout.aboutads.info.
- Email and Promotional Offers. When you contact us through certain forms on the Site or through email, you may be added to our email list to receive email messages. At any time, you can choose to no longer receive such emails by using the "unsubscribe" method found in each email or by contacting us as provided below.
- Access, Correction, or Deletion. If you have any questions regarding this Privacy Notice, have a specific request to access, correct, or delete any personal information that you have provided to us, or if you feel that the Site has not followed its Privacy Notice or Terms of Use, contact us as provided below. Note that we may have to delete your user account on the Site in order to delete your personal information. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
No Collection of Information from Children
Our Site is not intended for children under 18 years of age. We do not solicit or knowingly collect any information from visitors under 13 years of age, and please do not use the Site if you are not yet 18. If we learn we have collected or received personal information from a child under 13, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us immediately through the Contact Information section below.
"Do Not Track" Signals
Residents of certain states, including California and Delaware, may be subject to particular statutes requiring disclosure of how the Site responds to web browser "do not track" signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of personal information about their online activities over time and across third-party websites or online services. Although it is not clear that any such statute applies to our operation and your use of the Site, you should not use the Site if you desire a "do not track" signal, because the Site may not honor it.
Additional Privacy Rights for California Residents
California residents may have additional rights under the California Consumer Privacy Act of 2018 ("CCPA"), subject to certain limitations. The obligations and rights in this section do not apply to personal information we collect from or about job applicants, vendors, suppliers, independent contractors, current or former employees and staff, officers, directors, or owners of GFit Nutrition or residents of any state other than California. No user of the Site will be discriminated against for exercising their rights under the CCPA.
As described in this Notice, we may collect the following categories of personal information from users of the Site:
- Name, contact information and other identifiers, including but not limited to email, IP, home, and business addresses, phone number, login credentials, and personal and online identifiers;
- Age or date of birth;
- Health and fitness information you voluntarily provide (such as height, waist measurements, weight, and activity level), used to personalize your program experience;
- Internet or other electronic network activity information, including but not limited to browsing history, search history, and information regarding a user's interaction with the Site, other internet websites, or advertisements;
- Geolocation data, including but not limited to city, state, and zip code; and
- User preferences regarding the Site and our products.
Subject to certain exemptions, if you are a California resident, the CCPA grants you the following rights:
- Request to Know. California residents have a right to request a copy of particular information we have collected about you, up to two (2) times in a 12-month period, subject to certain exemptions. We will deliver this information, free of charge, by mail or electronically in a portable and, to the extent technically feasible, readily usable format.
- Request to Delete. California residents have a right to request that we delete any personal information about them that we have collected through the Site, subject to certain exceptions. Once we receive and confirm your verifiable request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
- Right to Opt-out of Sale of Personal Information. The CCPA gives California residents 16 years of age or older the right to opt-out of the sale of their personal information at any time. This Site is not intended for use by children, so we do not sell the personal information of consumers we know are less than 16 years of age.

Using the Site from Outside the United States
This Notice is intended to cover collection of information on or via the Site from residents of and within the United States. If you are visiting the Site from outside the United States, please be aware that the data protection laws governing this Site might not be as restrictive as those in your country. By using the Site, you understand that your information may be transferred to our facilities and those third parties with whom we share it as described in this Privacy Notice.
Data Security
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Our Site is hosted on Amazon Web Services (AWS). Payment transactions are processed by Authorize.net under their security standards. Sign-in is handled via secure email link rather than passwords, to reduce account-takeover risk. Clarity is configured to mask sensitive input fields.
Unfortunately, the transmission of information via the internet is never completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our Site. Any transmission of personal information is at your own risk. We are not responsible for failure or circumvention of any privacy settings or security measures contained on the Site.
